§ 4-30. Powers.

  • The liquor control commissioner shall have the following powers, functions and duties with respect to licenses, other than licenses of manufacturers, importing distributors, distributors, nonbeverage users, railroads, airplanes and boats:

    (1)

    To grant and/or suspend or revoke for cause all local licenses issued to persons for premises within the city and in the event of a suspension, to suspend licenses for not more than seven days for the first offense, not more than 15 days for the second offense, and not more than 30 days for the third offense and each subsequent offense and to revoke licenses for cause. In lieu of a suspension, the commissioner may impose a fine of not more than $1,000.00 for each violation. The maximum fine that may be imposed upon any licensee from the period of the license shall not exceed $10,000.00. As used herein "cause" shall include, but shall not be limited to, any violation of city ordinances and state and federal laws and regulations.

    (2)

    To enter or to authorize any law enforcing officer to enter at any time upon any premises licensed pursuant to this chapter to determine whether any of the provisions of this chapter or state law, or any rules or regulations adopted by him or by the state commission have been or are being violated, and at such time to examine said premises of the licensee in connection therewith.

    (3)

    To receive complaints from any citizen within the city that any of the provisions of the state law or this chapter, or any rules or regulations adopted pursuant hereto have been or are being violated and to act upon such complaints in the manner prescribed in this chapter.

    (4)

    To require every licensee to keep and maintain books and records pertaining to all business conducted at the licensed premises, and upon violation of any of the provisions of this Chapter 4, to require the licensee to make such books and records available upon reasonable notice for the purpose of investigation and control by the Liquor Control Commission, which books and records must be maintained in the State of Illinois.
