§ 14-24. License fee; surety bond; cash deposit.

  • (a)

    Prior to the issuance of any peddler's license, there shall be deposited with the city clerk a surety bond in the amount of $500.00, or a cash deposit of $250.00, and such bond or deposit shall be held by the city clerk for a period of six months for the benefit of any person who suffers loss or damage as a result of the purchase of merchandise from said person licensed under this article, or as a result of the negligent or intentionally tortious act of the person licensed under this article. If, prior to the expiration of the six-month period, a citation or charge has been filed against the holder of any peddler's license, charging a violation of any provision of these ordinances, said bond may be held until the termination of said case and, in the event there is a conviction upon any such ordinance violation, the bond may be applied to payment of any fine and court costs and the bond may be forfeited in the event of failure of the defendant to appear in court. The city clerk shall pay any portion of the bond or deposit to any person, or to the city, in accordance with the order of a court without making an independent finding as to the amount of the bond or deposit that is payable to that person or the city.

    (b)

    Every person desiring a solicitor's license shall pay to the city a license fee of $25.00 per week for a single license and $10.00 for each additional license per week. Every person desiring a peddler's license shall pay to the city a license fee of $100.00 per week for a single license and $25.00 for each additional license per week. All license fees shall be payable in advance. Provided, however, that any person, firm or corporation having a regular customer route and visiting each customer not less than biweekly, and being registered pursuant to the Retailer's Occupation Tax Act of the state, shall pay a license fee of $100.00 per year.

    (c)

    Any license or certificate issued pursuant to the provisions of this article shall expire on December 31 in the year in which it was issued.
