§ 10-1. Definitions.

  • As used in this chapter, the following words and phrases shall have the meanings ascribed to them in this section:

    Food dispenser shall mean any person, corporation, association or partnership who for a financial gain keeps for sale, sells, or serves to the general public, for consumption on the premises of the dispenser, or on the sidewalk or public way, or other building contiguous to such premises, any article of food or drink for human consumption. Restaurants, coffee-houses, tea rooms, ice cream parlors, confectioneries, lunch rooms, lunch stands, box lunch deliveries, luncheonettes, cafeterias and other like establishments, itinerant food vendors and retail drugstores serving lunches and drinks shall be included in the term "food dispensers."

    Food surveyor shall mean any person, corporation, association or partnership operating a retail establishment for the sale of, or selling or offering for sale or delivering for consumption any article of food or drink, other than intoxicating liquors or drugs, used or intended for human consumption, where the same are not sold, delivered or served for consumption on the purveyor's premises.

    Serves shall mean the placing of an article of food or drink for the convenience of a patron into any cup, glass, cone, plate or other receptacle from which the patron may conveniently consume it, or with which he may carry the same away from the dispenser's or purveyor's premises.
